Terms of Service

These Terms of Service (“Terms”) govern your access to and use of the BetterSelf mobile application (“App”) and related services (“Services”) provided by The BetterSelf Company (“Company,” “we,” “us,” or “our”).

2. Acceptance of Terms

By downloading, installing, accessing, or using the App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, you must not use the App or Services.

These Terms constitute a legally binding agreement between you and The BetterSelf Company. Your use of the Services is also subject to the App Store’s End User License Agreement (EULA), which you agreed to when downloading the App.

3. Eligibility and Registration

3.1 Age Requirements

You must be at least 17 years old to use the App. By using the App, you represent that you meet this age requirement and have the legal capacity to enter into these Terms.

3.2 Account Creation

To access certain features of the App, you must create an account by providing:

  • A valid email address
  • Phone number (for security purposes)
  • Country of residence
  • Year of birth
  • Other information as prompted during registration

3.3 Account Responsibilities

You agree to:

  • Provide accurate, complete, and up-to-date information
  • Keep your account credentials secure and confidential
  • Notify us immediately of any unauthorized access to your account
  • Be responsible for all activities that occur under your account
  • Maintain only one account per person

4. Description of Services

BetterSelf is a health and personal development, habit-tracking application that provides:

4.1 Core Features

  • Habit Tracking: Tools to monitor and track personal habits and goals
  • Workout Logging: Recording and tracking fitness activities and exercises
  • Progress Analytics: Visual representation of your progress and achievements
  • Goal Setting: Features to set and track personal development goals
  • Personalized Content: Customized recommendations and insights
  • Health Data Integration: Real-time display of HealthKit data (steps, sleep) without storage
  • Dashboard Views: Separate interfaces for Steps, Sleep, Habits, Workouts, and Analytics

5. Subscription Terms and Billing

5.1 Subscription Plans

The App operates on a free model with basic features available for free. Subscription options may include monthly, quarterly, or annual plans.

5.2 Payment Processing

  • Payment Method: All payments are processed exclusively through the Apple App Store using Apple’s In-App Purchase system
  • Billing: Your iTunes account will be charged at the confirmation of purchase
  • Currency: Prices are displayed in your local App Store currency and include applicable taxes
  • Apple’s Responsibility: Apple is responsible for all payment processing, billing disputes, and transaction management

5.3 Auto-Renewal

  • Subscriptions automatically renew for the same period unless cancelled
  • You will be charged no more than 24 hours before the start of each renewal period
  • The subscription price may change with notice as described in Section 5.5

5.4 Free Trials

  • We may offer free trial periods for new subscribers
  • If you do not cancel before the free trial ends, you will be charged for the subscription
  • Any unused portion of a free trial is forfeited when you purchase a paid subscription

5.5 Price Changes

  • We reserve the right to change subscription prices at any time
  • For existing subscribers, we will provide at least 30 days’ notice of price increases
  • Continued use of the Service after a price increase constitutes acceptance of the new pricing

5.6 Refunds and Cancellation

  • Refund Policy: All payments are processed by Apple through the App Store. We do not process refunds directly
  • Apple’s Refund Policy: Refunds are subject to Apple’s standard refund policy. You can request refunds through your Apple ID account settings or at reportaproblem.apple.com
  • Cancellation: You can cancel your subscription at any time through your App Store account settings
  • Cancellation Takes Effect: Cancellation takes effect at the end of your current billing period
  • Continued Access: You will retain access to premium features until the end of the paid period
  • No Partial Refunds: No refunds are provided for partial subscription periods unless required by applicable law or Apple’s policies

5.7 Payment Issues

If Apple cannot charge your iTunes account:

  • You remain responsible for any uncollected amounts
  • Apple may attempt to charge updated payment information
  • Your subscription may be suspended or terminated for non-payment
  • This may affect your access to premium features
  • Contact Apple Support for billing-related issues

6. Acceptable Use Policy

6.1 Permitted Use

You may use the App for personal, non-commercial purposes in accordance with these Terms and applicable laws.

6.2 Prohibited Activities

You agree NOT to:

  • Use the App for any illegal or unauthorized purpose
  • Violate any applicable laws or regulations
  • Infringe on intellectual property rights
  • Upload harmful, offensive, or inappropriate content
  • Attempt to reverse engineer, hack, or compromise the App’s security
  • Share your account credentials with others
  • Create multiple accounts
  • Use automated tools to access the App (bots, scrapers, etc.)
  • Interfere with other users’ use of the App
  • Circumvent any technical limitations or restrictions
  • Submit false ratings or reviews through the in-app rating system
  • Spam our contact/support system

6.3 Content Standards

Any content you create or share through the App must:

  • Be accurate and truthful
  • Respect others’ privacy and rights
  • Comply with applicable laws
  • Not contain harmful, offensive, or inappropriate material

7. User Content and Data

7.1 Your Content

  • You retain ownership of all content you create or upload to the App
  • You are solely responsible for your content and its accuracy
  • You grant us a limited license to use your content to provide the Services

7.2 License to Company

By using the App, you grant The BetterSelf Company a non-exclusive, worldwide, royalty-free license to:

  • Use your content to provide and improve the Services
  • Create aggregated, anonymized data for analytics and service improvement
  • Display your content within the App as necessary for functionality

7.3 Data Processing

Our collection and use of your personal data is governed by our Privacy Policy. By using the App, you consent to such processing as described in the Privacy Policy.

8. Intellectual Property Rights

8.1 Company Rights

The App and Services, including all software, designs, text, graphics, logos, and other content, are owned by The BetterSelf Company or our licensors and are protected by intellectual property laws.

8.2 License to You

We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for your personal use in accordance with these Terms.

8.3 Restrictions

You may not:

  • Copy, modify, distribute, or create derivative works of the App
  • Use our trademarks, logos, or brand elements without permission
  • Remove or alter any proprietary notices
  • Sell, rent, lease, or sublicense the App

9. Health and Safety Disclaimers

9.1 Medical Disclaimer

  • The App is not intended to diagnose, treat, cure, or prevent any medical condition
  • The App does not provide medical advice
  • Always consult a healthcare professional before making health-related decisions
  • Do not rely on the App for medical emergencies

9.2 Fitness Activities

  • Exercise at your own risk and within your physical capabilities
  • Consult a doctor before beginning any exercise program
  • Stop exercising immediately if you experience discomfort or pain
  • We are not responsible for injuries resulting from app-guided activities

9.3 Data Accuracy

  • Fitness and health data tracking may not be completely accurate
  • Do not rely solely on App data for medical or health decisions
  • Data is for informational and motivational purposes only

10. Privacy and Data Protection

Your privacy is important to us. Our Privacy Policy, which is incorporated by reference into these Terms, explains how we collect, use, and protect your information. Key points include:

  • We collect only necessary information to provide the Services
  • We access Apple HealthKit data for real-time display within the app but do not store this data in our databases
  • You can request deletion of your data at any time
  • We comply with GDPR and other applicable privacy laws

10.1 Third Party Services and Analytics

Firebase (Google): For analytics, crash reporting, and authentication

OVH: For email delivery services

Apple HealthKit: For health data integration (display only, not stored)

11. Third-Party Services and App Store Terms

11.1 Apple App Store Requirements

Your use of the App is subject to the Apple App Store Terms of Service and End User License Agreement (EULA). In case of conflict between these Terms and Apple’s terms, Apple’s terms will prevail regarding:

  • Payment processing and billing
  • Refund policies and procedures
  • App distribution and updates
  • Technical support responsibilities

11.2 Apple’s Role

  • Apple is not responsible for the App’s content, functionality, or support
  • Apple has no obligation to provide maintenance or support services
  • All product liability claims should be directed to The BetterSelf Company
  • Apple is a third-party beneficiary of these Terms and may enforce them against you

11.3 Third-Party Integrations

The App integrates with Firebase Analytics, Firebase Crashlytics, OVH email services, and Apple HealthKit. These integrations are subject to their respective terms and privacy policies.

11.4 Export Control

You represent that:

  • You are not located in a country subject to U.S. Government embargo
  • You are not listed on any U.S. Government list of prohibited or restricted parties
  • You will comply with all applicable export laws and regulations

12. Disclaimers and Limitations

12.1 Service Availability

  • The Services are provided “as is” and “as available”
  • We do not guarantee uninterrupted or error-free service
  • We may modify, suspend, or discontinue the Services at any time

12.2 Warranty Disclaimer

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

12.3 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE SERVICES IN THE 12 MONTHS PRECEDING THE CLAIM
  • WE SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • THIS INCLUDES DAMAGES FOR LOST PROFITS, DATA LOSS, OR SERVICE INTERRUPTION

13. Indemnification

You agree to indemnify, defend, and hold harmless The BetterSelf Company and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:

  • Your use of the App or Services
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Any content you upload or share through the App

14. Termination

14.1 Termination by You

You may terminate your account at any time by:

  • Deleting your account through the App settings
  • Contacting us at info@better-self.co
  • Cancelling your subscription through your app store account

14.2 Termination by Us

We may suspend or terminate your access to the Services:

  • For violation of these Terms
  • For illegal or harmful activity
  • If required by law
  • At our sole discretion with or without notice

14.3 Effects of Termination

Upon termination:

  • Your access to the Services will cease
  • Your data may be deleted according to our Privacy Policy
  • Paid subscriptions will continue until the end of the billing period
  • These Terms will survive termination where applicable

15. Dispute Resolution

15.1 Governing Law

These Terms are governed by the laws of England and Wales, without regard to conflict of law principles.

15.2 Jurisdiction

Any disputes arising from these Terms or your use of the Services shall be subject to the exclusive jurisdiction of the courts of England and Wales.

15.3 Informal Resolution

Before pursuing formal legal action, please contact us at info@better-self.co to attempt to resolve any disputes informally.

16. Changes to Terms

16.1 Updates

We may update these Terms from time to time to reflect:

  • Changes in the law
  • New features or services
  • Changes to our business practices

16.2 Notice

We will provide notice of material changes by:

  • Posting updated Terms in the App
  • Sending email notification
  • Providing in-app notifications

16.3 Acceptance

Continued use of the Services after changes become effective constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Services.

17. General Provisions

17.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and The BetterSelf Company regarding the Services.

17.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.

17.3 No Waiver

Our failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights.

17.4 Assignment

You may not assign or transfer your rights under these Terms. We may assign our rights and obligations without restriction.

17.5 Force Majeure

We are not liable for any failure to perform our obligations due to circumstances beyond our reasonable control.

18. Apple-Specific Terms

18.1 Acknowledgment

You acknowledge that these Terms are concluded between you and The BetterSelf Company only, and not with Apple. The BetterSelf Company, not Apple, is solely responsible for the App and its content.

18.2 Scope of License

The license granted to you is limited to a non-transferable license to use the App on Apple devices that you own or control as permitted by the Usage Rules in the Apple App Store Terms of Service.

18.3 Maintenance and Support

Apple has no obligation to furnish maintenance and support services for the App. The BetterSelf Company is solely responsible for providing support as described in these Terms.

18.4 Warranty

Apple provides no warranty for the App. In the event of any failure of the App to conform to applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) according to Apple’s refund policy. To the maximum extent permitted by law, Apple has no other warranty obligation regarding the App.

18.5 Product Liability

The BetterSelf Company, not Apple, is responsible for addressing any claims relating to the App or your use of it, including:

  • Product liability claims
  • Claims that the App fails to conform to legal or regulatory requirements
  • Claims arising under consumer protection legislation

18.6 Intellectual Property

In the event of any third-party claim that the App infringes intellectual property rights, The BetterSelf Company, not Apple, will be responsible for investigation, defense, settlement, and discharge of such claims.
